This website is operated by BerkZerk3D. Throughout the site, the terms “we”, “us”, and “our” refer to BerkZerk3D. By accessing our website or purchasing from our shop, you agree to be bound by these Terms of Service and any related policies linked throughout the site, including our Refund Policy and Privacy Policy.

1. Store Terms
By using this site, you confirm that you are of legal age in your region or have permission from a legal guardian. Our products may not be used for any illegal or unauthorized purpose. Any breach of these Terms may result in the immediate termination of service.

2. Custom Orders & Fulfillment
All products are made-to-order. Standard production time is 1–3 weeks depending on order volume. Once an item has been shipped, the order is final. You may request a cancellation before the item ships.

3. Shipping
We primarily use USPS for shipping. We are not responsible for delays due to customs, postal service disruptions, or incorrect address info provided by the buyer. Shipping charges are non-refundable once an item has shipped.

4. Refunds & Damaged Items
We do not accept returns.
Refunds are only issued for unshipped orders (item + shipping). Once shipped, only the cost of the item may be refunded if an exception is made.
Damaged items:
USA orders: We will send replacement parts.
International orders: Partial refunds may be issued due to shipping costs.
Contact us within 7 days of delivery with your order number and photos of any damage.

5. Intellectual Property & Product Use
All 3D models sold as physical prints on BerkZerk3D are sold with either full commercial rights or express permission/consent from the original creators to produce and sell physical copies. We are authorized to legally produce and sell these physical items. Digital files are not sold or shared under any circumstance.
Buyers are free to modify, repaint, or resell the physical items they purchase. However, if you are interested in obtaining the original 3D files, we’re happy to direct you to the original designer or source for proper licensing and purchase.

Some products feature characters or designs that may share similar names, appearances, or themes with those from popular franchises. These are considered fan art and are unofficial, unlicensed works. They are not affiliated with, endorsed by, or produced in partnership with any original copyright holder. All such items are sold as inspired collectibles intended for personal use only.

7. Important Notice: Prop Weapon Disclaimer
Some items sold on BerkZerk3D are prop weapons intended for cosplay or display purposes only. It is your responsibility to follow all local, state, or national laws regarding the possession, transport, and display of replica weapons. This may include requirements such as orange tips, transport restrictions, or event-specific regulations.
Please note: We do not include orange tips by default. If you require one, you must request it at the time of purchase.
BerkZerk3D is not responsible for any legal issues or consequences resulting from misuse or failure to comply with relevant laws.
